Randall Hopley, the man accused of kidnapping a Sparwood boy, isn’t asking for bail, reports the CBC.
Kienan Herbert, a three-year-old Sparwood boy, went missing from his family’s Sparwood home this September. The disappearance prompted a major search but ended when Kienan was returned to his bed. Police arrested Randall Hopley in connection with the case.
William Thorne, Hopley’s lawyer, said there was little chance bail would have been granted because his client had already breached bail conditions from an earlier alleged break and enter.
“So it was Mr. Hopley’s responsibility to convince a court that he should be released,” Thorne said. “He didn’t feel, after we had our discussion, that that would likely happen so on my advice he decided not to proceed with a bail hearing.”
